LUMBERTON — No charges have been filed in the shooting death of a Pembroke man on Tuesday afternoon.

“We’ll get all the facts together and the case will be presented to the District Attorney’s Office,” said Maj. Anthony Thompson, chief of detectives for the Robeson County Sheriff’s Office.

William Michael Chavis, 61, fired the shot that killed 50-year-old Toby Oxendine, accordnig to Thompson, and Chavis was also injured in the exchange.

According to Thompson, Oxendine went to Chavis’ Solomon Road home, “there was an exchange of words between the two men,” and they began fighting. Oxendine then pulled out a gun and the men struggled over the weapon before it went off, striking Chavis in the back of the head, Thompson said.

Oxendine began to flee and was shot by Chavis with a different gun, Thompson said.

Both men were taken by Emergency Medical Services to Southeastern Regional Medical Center, where Oxendine died. He lived on Oakgrove Church Road in Pembroke. Chavis was treated and released from the hospital.

Thompson said the District Attorney’s Office will review the case to determine if Chavis acted in self-defense and if charges are warranted. It’s unclear what the men were arguing about and how they knew each other.

In a separate case, there are no suspects in the death of a Fairmont man found shot in his green Honda Accord on Saturday.

Roscoe Bell Jr., 60, of Pleasant Hope Road in Fairmont, was dead when law enforcement arrived on Valtlee Drive in Lumberton at about 6:30 a.m.

Thompson declined to say whether Bell had been alone, but said officers believe Bell was shot by two men who pulled up in a gold van. According to Thompson, the men got out of the van and it was driven away before returning to pick them up.

Thompson said he could not say whether Bell had been targeted, citing the ongoing investigation.
