Shooting death case goes to DA

LUMBERTON — A Lumberton man who shot and killed a suspected intruder Sunday had been the victim of a burglary earlier this month during which a handgun had been reported stolen, according to Lumberton police Capt. Johnny Barnes.

Police have turned the findings of their investigation into the shooting death of 34-year-old David Allen Hinson over to the county District Attorney’s Office, which will make the decision on whether 52-year-old Donald Forbus will be charged with a crime.

Barnes said that on May 4, Forbus received a call from a neighbor who told him that the front door of his home at 106 Hayes St. was open. Forbus returned home to find a door kicked in and holes knocked in the walls. Forbus reported that a $200 ladder, a $300 chain saw, and a .32-caliber revolver valued at $50 had been stolen; none of the items have been recovered.

On Sunday, Forbus told investigators that he shot Hinson on the front porch of his home. Forbus said, according to Barnes, that he had heard a noise outside of his home shortly after 5 a.m. that day and when he opened the door, there was a confrontation with Hinson. After shooting Hinson once, Forbus called 911. Barnes has not released information on where Hinson was struck.

Forbus has no prior criminal history, according to Barnes. Barnes said “at the time of the shooting” Forbus told investigators he did not know Hinson. Several people have left comments on The Robesonian’s website saying that Hinson knew Forbus’ children.

According to Barnes, the porch on Forbus’ home is enclosed, which makes it essentially another room on the home; however, any porch attached to a house is considered to be property that the owner has the right to defend under the Defense of Habitation law.

“There’s been laws on the books since probably the mid-90s that gives the person a right to defend themselves in their home,” Barnes said.

The law, nicknamed the “castle doctrine,” gives a legal occupant the right to use deadly force to protect themselves against unlawful entry into property that person inhabits. In December, the state loosened the doctrine to include a person’s vehicle, workplace, and property surrounding their home.

“The porch had a doorway and no door, but that doesn’t matter,” Barnes said. “Even if it was not enclosed and someone walked in, they would still be breaking or entering.”

Barnes said a detective noted that a window on the front of the home, within the enclosed porch, was broken when he arrived Sunday. A baseball cap, which did not belong to Forbus, was found in the yard.

Hinson has previously faced charges for driving while impaired, simple assault and injury to real property. Hinson’s funeral is scheduled for today. He is survived by two children, and was engaged to be married, according to his obituary.

I understand the profound sadness, and even anger in losing your loved one. You all have post after post about finding the truth and finding justice, but you all have already made your minds up as to what the truth is. You don't want justice, you want revenge. It is truly a sad ordeal for all involved.

Justice or Revenge,Call it what you want, but I and everyone else that knew David knows that he was not breaking in Mr Forbes's house that night, There is no way Im going to let his daughter grow up to think of her daddy was a thief. There is more to the story.

What are you waiting on Mr. DA? The medical examiners report has been back since the first of July. Are you going to let Mr. Forbus get away with murder. He's still walking the streets, while David is laying in a grave. It's time to get the buddy system and politics out of the justice system and start finding the facts.

So much has been said concerning Davids death. It's so hard to believe one bullet did so much damage to Davids body. If the EMS were on the site, they couldn't have saved him. The medical examiners report said he was shot a close range. He weighed 131 lbs. How could somebody that size, unarmed be a threat? I just don't understand. I hope Kayce is greaving as musch as Lexie and Dunk are.

Its been 7 days since the DA had the case sent to him.....I have been looking for any news in the Robesonian to see Justice happen for David and seen nothing yet. I pray that justice is served quickly, and I pray his family finds some comfort in that justice.

I was told that the DA wouldn't even look at the case until he received the examiners report. That could take from 6-8 weeks. This is going to be a long wait.

I would like to inform them of a few things from the last few days. First, Hope is my cousin and if you dont consider her your kin then you might better check to see if you are kin to me. She has been in this family since day one and is one of my closest kin. Further more if the ins. on David was any concern of any one, they already know. But to let you know, Rikki lynns mother paid every penny for the ins. The funeral was paid by the ins. and so was the cremation, service and barial. The lot was furnished by David Jrs. Dad. Rikki Lynns Mom paid for the spray and the two flowers from the kids. People run there mouth about things they have nothing to do with or know about and some one gets hurt. I am asking all of you to please be quiet about stuff you dont know and realize just how important our family is. I love all of you but you really have to learn to pull together at times like these.

I do have one more thing to add. I am just curious as to why, if you had just shot someone, would you call someone to come get your daughter and grandson before you called the law to report that you had just shot an intruder??? The papers article had also advised that the homeowner stated that he immediately dialed 911 after he shot David Allen Hinson Jr. His phone records should be verified to find out exactly who he called immediately after the shooting. It's to my understanding, that he called family first or someone at least to come and get his grandson before he called 911. Why? It's sounds like to me that he had a clear thought process and wanted to keep it from the public eye that not only was his grandson there but his daughter may have been there too. Was his daughter there? If that were the case, I would place my money on that as to why David Allen Hinson Jr. was on this mans porch at 5:00am. I would even go so far as to speculate that David Allen Hinson Jr. was in fact not coming but going and furthermore, has the questions been answered as to why David's belongings were 30 ft or more away from where his body was??????????? It would take the blast from a 50 cal. to throw the VICTIMS personal property that far of his person. Also there is the question as to where David Jr. was between the hours of 11:30 pm and 5:00 am. Where was David ? Who was he with? I can promise you one thing he weren't by himself? It would appear that a different confrontation could have taken place all together. David wasn't a coward either. No matter how much bigger the opposition was. He would stand his ground. Get the truth guys we are counting on you "OUR MEN AND WOMEN IN BLUE" NOTE TO READER: Marines are well trained in interrogations. Need I say more? If this case is to close to home or personal for you in any way, call in the suits. Better safe than sorry, and we have a responsibility to the homeowner and to the deceased. All are pleading with you, not took look at either man's prior record, but find out the truth about that night only. We sincerely want to know either way! Why else would so many be showing so much interest in a guy whom we know is likely to be viewed or pawned off as another guy who got what he deserved? Why? Because it weren't David Allen Hinson Jr's M freaking O ( M.O )...

David Allen Hinson Jr. is my brother. I am the only sister he has. I grieve every day since my brothers death. I cant sleep without seeing his face. I dont think its fear. Whats happened to him is wrong. He wasnt only taken from me but his babys. It isnt fair to any of us. my pain will never heal. Justice will served if not by law by GOD... David JR. was my ex-son-in-law. He like to party, drive big trucks and listen to old rock and roll. Sounds like a whole lot of you out there. Even though he and my daughter were divorced, they talked often (david called her when he needed someone to talk to.) and Lexie stayed with him on weekends. He signed her up and took her to soocer practice. He went to the PTO meetings at Long Branch, He was very involved in her life. She will be 8 on June 2, But he won't be at this birthday party. She has asked so many questions about his death, and I rely on God to help me answer them. Questions like why did that man shoot my daddy? or was my daddy hurting that man? but the hardest one was , "Are you sure I'm never going to see my daddy again?" Heaven just doesn't satify a 8 year old where her daddy is concerned. It did when her dog was hit by a car 6 weeks ago. but not with her daddy. Just want you to know Mr. Forbes, your daughter still has her daddy, but not her boyfriend, you took care of that. The first article stated that Mr Forbes didn't know David. If he would lie tell one lie, what makes you think he won't tell another. I really think this case needs to be investedgated to the fullest. Lexie and everyone else need some answers. I also heard that 20 yrs ago, when he was davids age he had a recod. Funny it;s not showing up now. Maybe because he has relatives that work for LPD. HUUUMMMM.

To everyone that loved David Allen I really apreciate it. Im his ol' Lady Danielle. David Allen was a one of a kind person, and no matter how mad he made you, you just had to love him. Ive lived with David Allen for the past five years, Ive talked to him every night. He gave me the most beautifulist son you could ask for. He also introduced me to his beautiful daughter. David was a good person he never took anything from anybody. If For Anything at 5 in the morning David Allen was probabley looking for a place to rest. He may have mistaking the wrong porch. But Does This give Anyone the right to Kill Him. why didnt Mr.Forbes call the police before he opened his door to a stranger at 5am if he felt threatened. I really think more happened than is being said and I hate to know that I probabley wont Know. I just want anyone if thay do know if something happened besides what is said please come forwared. Just remember David Allen Had Children. WHY do they have to suffer? and tell me this how do you tell a 2yr old that his Daddy is never comming home.Because Im going to have to.Why did He have to die? what if he needed help and was needing to use the phone because the phone he had didnt have any time on it. But believe me I wont rest until I find out what happened To David Allen He was my Man, My Sons father and He did Not deserve to go out like that. All I want to know is what He was doing in between 1130pm and 500am. Who was David Allen with? Dont be scared just come and let me know come over And Look his child in the face and tell him what happend to his Daddy. Thanks to everyone that has been there for me and rikki lynn and David Allen's children in our time of need because if anyone knew David Allen They know that He really loved us. And there is no one that could ever take his place.

From the mother of the victim in this crime...

My son was not an intruder but a visitor of the home. He did not steal or try to break into this mans house. This has changed our lives in a very terrible way. This man said my son confronted him. I would really like to know what he said. The paper never said that the man said any thing to my son. Did he just open the door and shoot him. Take him away from me so fast? Took him away from his children so fast? His brothers, sister and father have really had a very bad time with this. I feel like some one has taken my heart out of my chest and stole my soul. I expect justice to be done but i dont feel like it will. When my son was shot, there was no tape put around the scene of the crime. After the body was removed from the so called scene of the crime the shooter was allowed to wash the blood off of his porch with a water hose. My son blead to death on this mans porch and the man, who has family in the police dept. was never hand cuffed or even taken to the police dept. for questioning. This was just been blown to the side like my son might have been some kind of animal. I know my son had some pending charges against him, but i also know the shooter is an ex marine, combat trained and he also has a history of charges for holding some one at gun point and receiving stolen property. This has also been kept from the public. sounds like i may need to call in some one that will be over the investigator, the lumberton police and the DA to make sure justice is done. If this man knew how it felt to lose a child, he would have never took the life of david Jr. If he knew how it felt to have to tell a child that there daddy is gone and would never come back or to have to hold his brothers and sister and try to make them understand why this man took our loved one away in such a brutal way when he could have just told him through the door that he had called the police and he had a gun. David Jr. would have left. The shooter was trained to defend his self and could have probly took David Jr. in one hand while he called 911 with the other. there was no need in the death of David Jr. There was no need in the pain. But now there is a need in justice. I was asked to give the detective a chance to do his job. I will. But if justice is not done and done the way it is supposed to be, I just hate to think what might happen if this man is not taken off of the street. I've heard how he is planning to move, I also thought that was illegal during a so called investigation. My son did not deserve what he got but at least the lumberton police dept. could do is give him justice but I know they won't and he will have died because some one else broke into this mans house and the man decided he would stop the next one to come to his porch. Does this mean that if an under cover cop with a pistal on his side comes on my porch and I look out my window and see him and I feel threatened that I can shoot him through the door and never be hand cuffed or taken to the police station? If it would have been an officer instead of David Jr. on that porch that morning to give that man some information on a family member and he would have been shot and died, the shooter would have went to jail without bond and the house would have been taped up. I really hope these people do the job we pay them to do but I am affraid this man thinks he is going to walk. GREAVING MOTHER OF DAVID ALLEN HINSON JR.

Well first of all let me say that David, brother you'll truly be missed!!!! You've touched everyone that you have come in contact with an impression that they'll never forget. Our friendship goes so far back and I'll cherish the memories good or bad.

To the Hinson Family, Danielle, lil man, Lexi (Bean), Rikki Lynn & all the family and friends that David loved. My prayers go out to all of you to be able to cope with this tragedy and lose of a man who didn't deserve to go out like this!!

Now to the DA, Law Enforcement, Investigators and ppl with common sense. Now I am all for the 2nd Amendment and for protecting what WE work hard to have to have someone take it from you… But whoever wrote this law and put it into action was a little stupid. 100% COMMON SENSE needs to be taken into consideration (which is lacking in RobCo). This man who shot and killed my friend, being that he was just broken into on May the 4th according The Robesonian. Why was calling 911 the 1st thing done when he heard some noise outside (the police station isn't barely a mile away). But to GRAB a GUN and OPEN the door and SHOOT this man... That is absolutely STUPID, you're asking for trouble!!! Call 911, Let the Person Know That You Have A Gun & That You Will Shot Them If They Enter Your Home & that you have called the police!!!! I think 9.5 times out of ten the person that is NOT in the home will NOT TRY to ENTER. They may stand there and talk trash or maybe beat on the door. But until that door is OPENED by that Person on the OUTSIDE we have to think logically about things.

Unfortunately this is a mistake that can NEVER be taken back and sooooo many ppl will suffer the consequences of this man's actions. I hope and pray that justice will be done & this law will be looked at a little closer. Until then if we go the visit anyone unannounced, we're all target to get shot.

I HAVE LEARNED SOMETHING NEW. MAYBE THIS CASE AND DAVID'S DEATH WILL EDUCATE US SO THAT THIS WILL NOT TAKE PLACE AGAIN. I GUESS ALOT OF US ARE GUILTY OF 1st degree burgarly ( NOT B&E ) IF ALL IT TAKES IS ONE WALKING UP ON SOMEONES PORCH TO KNOCK ON THE DOOR AT NIGHT OR IN THE EARLY MORNING HOURS. BUT FIRST HAD TO WALK ACROSS A SEMI-INCLOSED AREA TO KNOCK ON THE ONLY DOOR THERE WAS. I AM NOT SAYING THAT IS WHAT HAPPEND BUT WOW!!! I WOULD HATE TO DIE UNDER THOSE CIRCUMSTANCES. I HAVE BROKEN DOWN TWICE RECENTLY AND ONE OF THOSE TIMES I ACTUALLY HAD TO DO JUST THAT. THE ARTICLE STATES THAT THE OWNER OF THE PROPERTY HAD BEEN BROKEN INTO RECENTLY AND I REMEMBER HOW I FELT ABOUT THAT.I WAS ANGRY, I FELT VIOLATED, AND TO BE HONEST I WANTED TO SHOOT SOMEONE MYSELF. One of two things will happen: Johnson Britt, the "ACTING" DA will either PERSECUTE (not prosecute) the shooter unlawfully so 2 or 3 of his fellow scumbag (spit) lawyers can make a few thousand TAXPAYER DOLLARS off of defending Mr. Forbus (and split the take with Britt, of course) or he'll go by what the law says and forget about it. Now what do you think he'll do?
