LUMBERTON — After a four-week trial in Robeson County Superior Court, a 12-person jury was unable to unanimously agree on the fate of a man who is accused of provoking a fatal stabbing in 2007.

The case of Adam Rozier, who is charged with aiding and abetting voluntary manslaughter in the death of 21-year-old Chad Allen Arnette, was declared a mistrial on Thursday by Superior Court Judge Greg Bell after the announced deadlock, according to Gwen Chavis, Superior Court trial coordinator.

Chavis said it was up to the Robeson County District Attorney’s Office whether or not the case would be tried again. Assistant District Attorney Tony Berk, who prosecuted the case, could not be reached for comment.

Arnette’s aunt did call The Robesonian on Thursday and said the case would be tried again. The Robesonian has learned the split was 8 to 4, but heard differing accounts on which way the jury was leaning.

Rozier is accused of provoking Drew Floyd to stab Arnette with a kitchen knife during an altercation at a parking lot on Roberts Avenue on Feb. 14, 2007. The altercation was prompted by a text message Arnette sent to Floyd’s girlfriend. Floyd was found guilty of voluntary manslaughter and sentenced in September 2011 to serve at least three years in prison.

The exchange between Berk and defense attorney Gayla Biggs was often heated during the trial. Before closing arguments on Wednesday, District Attorney Johnson Britt briefly joined the prosecution team as Biggs and Berk battled over wording in instructions that would be given to the jury.

“This whole proceeding has been marred by absolute bickering back and forth,” Britt told the court. “Now is a point where I feel I should come in, in my capacity as a district attorney, to return some civility to the trial.”

In a closing argument that lasted an hour and a half and was interrupted twice with objections by Berk, Biggs said that before the jury convicted Rozier of aiding Floyd in Arnette’s stabbing, they had to first decide if Floyd was guilty of voluntary manslaughter or if his actions were in defense of Rozier, whom Arnette had hit three times on the head with a T-ball bat.

“The state wants to paint Chad Arnette as a choir boy,” she said, jabbing a finger in Berk’s direction. “They want to paint him as a victim. They have run from the fact that he was beating him (Rozier) on the head with a bat and was not going to stop until somebody stopped him.”

In a 45-minute closing argument that was interrupted with seven objections from Biggs, Berk told the jury that Rozier was not a victim, but a “manipulator.” He said Rozier had instigated the incident by telling Floyd that Arnette had told him to “bring his boys” to the parking lot to fight.

“He was the only one who heard the words,” he said. “… Adam tells you it’s Chad’s idea … but what really led to these events?”

Berk said that Adam’s injuries were not serious enough to warrant the stabbing that took Arnette’s life.

“Was Adam seriously hurt, or was he bringing about the other two into the fray?” he said. “… Adam had malice. Adam wanted Chad hurt, and Adam initiated the whole event that ended with Drew Floyd stabbing Chad.”

I am sorry for the Arnnette familys' loss. I didn't know either side. By what the Robesonian has published leads me to believe that both Chad and Drew both brang people with them to this "fight". since they are charging Adam why don't they charge the other person that was with Chad? I mean the boy that was with Chad knew they were going to a "fight" and didn't try to talk him out of it... They get to the parking lot and he doesn't try to tell him to leave not to worry about it....we don't know what he said to Chad leading up to the moment, I'm sure he won't tell it either. Why can't the female that started it all be charge? I mean if it wasn't for her none of this would've happened. Right? I am a single mom of 3 boys...2 of them teenagers and we talk about this often. I tell them it is never worth your life or someone else's to fight or argue over a female. If it seems like that's what is happening walk away from her. People don't fight fair these days... I am sorry that a life was taken over a foolish female. My prayers to the family.

I agree. Well said. Both sides agreed to meeting @ that parking lot that night with intentions of fighting. Why wasn't the female ever charged? They are so quick to point fingers at Rozier as being the "instigator" but according to definitions of that word wouldn't that female be the "instigator". I don't know what those texts messages said nor do I care to know. She had a choice in the matter to stop the texts but she instead made the choice of showing them to her boyfriend, which started the chain of events that night. How come she didn't getting charged with AA 2nd degree murder? People can sit here and talk about no Justice in Robeson County. Money talks, blah, blah, blah. The one who responsible for the murder is serving his time and at least his family knows who killed him. My cousin was murdered in his bed a year ago and NO ONE has been charged.

Truths4..... I agree!

My mother always said.... If "they" told you to jump off the bridge would you? My answer always .... No.

We are responsible for our own actions, not the actions of others! No a mistrial does not mean innocence but obviously guilt was proven.

I believe this to be true, I have not seen no remorse from the Rozier Family.

So what you're saying is Chad was totally innocent, he didn't do anything wrong by hitting "an unarmed person" with a baseball bat.

No one really knows what happened that horrible day, except those that were there. It's easy to speculate and place blame, when something like this happens.

This was a very tragic situation and there will never be winners no matter what the outcome holds! All families have suffered. The parents had no control over the events that transpired into the tragedy that unfolded that horrible night. The Rozier Family has been deeply hurt and has nothing but sympathy for the Arnett family. They are good people and I know they pray every day for the Arnett family. I pray every day for everyone involved. As a mother I can’t imagine dealing with the loss of a child. I don’t think sending an innocent man to prison is going to bring peace. Peace will only come when forgiveness begins to fill your hearts! All those young men made bad decisions that night and as a result. Someone paid the ultimate price…it could have been Rozier! If I could say one thing to the parents of Chad it would be: I deeply regret your loss and there is not a day that goes by that I don’t think about what happened and I pray for you every day!

Rozier should have never been charged! The Arnette family has suffered a great loss but continuing a vendetta against someone who did not stab anyone is too much. Rozier did not take out a knife, it is time to put this to rest!

Floyd is serving his time... Justice has been served!

Prayers for everyone involved this was truly a tragedy.

How can you say that Rozier should have never been charged if Rozier would have kept his mouth shut Chad would not have been stabbed by Floyd. It all came out in the trial of Floyd and also in the Rozier trial. Just because it was a mistrial does not mean that Rozier is innocent of what he was charged with.

@TATUM24 How would you know how much money Roziers family has and what does where his mom works have to do with this case? If you want to talk about money then you should be focusing on the other family this case is a prime example of money talking, if it was not for money and political pressure on the DA's office this case would have never went to court. If you would have kept up with this case from day 1 you would remember how many months went by before Rozier was even charged if the victim would have been a young black male or an indian this would have been over a long time ago instead of wasting the tax payers money. Does Johnson Britt personally seek justice for every murder victim in this county as he has for this victims family, if he has not for yours then you may need to be calling the DA,s office to see if you can get some justice for your family member!!!!!

The person responsible for the stabbing and unfortunate death of Arnette has been tried and convicted and I've never understood why Rozier was ever even charged. He was getting beat up by Arnette (which he needed if he thought he was big and bad enough to charge at him) and his two friends came to his defense BUT why didn't Floyd just try to pull them apart like his other friend did. It was Floyd's choice to use the knife which he had brought along and had all intentions of using. In order for Rozier to be responsible for Arnette's death and what he is charged with, is if as he was getting beat he yelled out to Floyd to come to his rescue and use your knife. Did rozier say that? NO. I am sorry to the family of the murder victim that their loved one died but by pushing a prison sentence on someone else is not going to stop that pain or make things right.

Wow!!!! Big shock!!! Bet if he was black, & from the "southside", the county would be outraged at the outcome. But since hes not, no big deal!! No comments about how he was raised!! No comments about, where his father is!!! No NAACP jokes!!! Nothing!!! If dude was black, they wouldve had no problem finding him guilty, and everybody wouldve been happy!!! What a joke!!!

DaveJ, Umm, I want to tell you that your pereception of blacks is the same perception that others hold. Perception is reality, in most cases. Stereotypes are mostly justified by the actions commited.
